Terms of Service

You must be at least 18 years old and able to form a binding contract. You're responsible for any activity that occurs under your account, including the actions of any users you grant access to.

Namence provides shared, cloud, WordPress, VPS and dedicated hosting along with related services (domains, email, DNS, CDN). Resource limits and features depend on the plan you purchase and are described on the relevant product page.

You agree to pay the fees listed for the plan you select, in the currency shown at checkout. Recurring plans renew automatically until cancelled. Setup fees are non-refundable. NPR prices are inclusive of applicable GST.

You may not use the Services to host or distribute content that is illegal, infringes third-party rights, transmits malware, sends unsolicited bulk email, or otherwise violates our Acceptable Use Policy.

We may suspend or terminate the Services for material breach of these terms, non-payment, abuse, or as required by law. We will give reasonable notice where practical.

Our uptime commitments and service-credit remedies are described in the SLA. SLA credits are your sole remedy for downtime.

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Our aggregate liability for any claim is limited to the fees you paid for the affected Service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential or exemplary damages.

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. The exclusive venue for disputes is the state and federal courts located in Wilmington, Delaware.

We may update these terms from time to time. Material changes will be announced at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
